Truck driver fatigue
Direct prohibition49 CFR 392.3[1]
Separate inquiryDriving-hour compliance under Part 395[2]

Driver fatigue is a safety issue distinct from exceeding a recorded driving-hour limit. Section 392.3 prohibits operating a commercial motor vehicle when fatigue, illness or another cause impairs, or is likely to impair, the driver's ability or alertness so that driving is unsafe. A carrier may not require or permit that operation.[1]

Legal hours do not establish alertness

Hours-of-service rules set limits for covered driving, but Section 392.3 asks whether the driver can operate safely. A driver can be within a driving allowance and still be impaired by fatigue. Conversely, a recorded hours violation does not by itself prove that fatigue caused a particular crash. The log and the driver's condition answer different questions and should not be treated as interchangeable evidence.[1][2]

Work beyond driving

The definition of on-duty time includes more than time spent moving the truck. Subject to its qualifications, it includes work such as loading, unloading and attending a vehicle being loaded, as well as other work for a motor carrier. Supporting documents can help compare those activities with the duty-status record. An investigation should examine whether recorded rest was actually free of work duties.[3][4]

Carrier scheduling and the safety rule

Section 392.6 prohibits a carrier from scheduling a run so that it would require operation above applicable speed limits. Section 392.3 separately addresses unsafe impairment, with a limited grave-emergency provision. Together they direct attention to the trip requirements as well as the driver. Dispatch instructions may be relevant evidence, but a rushed schedule should not be asserted without records supporting that description.[5][1]
