A truck owner may lease equipment to an authorized carrier and may also drive it. Part 376 addresses covered equipment-leasing arrangements. Its requirements for a carrier's control and responsibility should not be confused with a universal determination that every owner-operator is an employee for every legal purpose.[3][1][2]
Identifying the arrangement
Section 376.11 generally requires a written lease when an authorized carrier uses equipment it does not own, subject to the regulation's scope and exceptions. Section 376.12 addresses required lease provisions, including duration, compensation and responsibility for specified expenses. A carrier name on a vehicle is useful identification, but the lease and the actual transportation arrangement are needed to understand who supplied the equipment and under what terms.[1][2]
Exclusive possession and responsibility
Section 376.12(c) requires a covered lease to provide for the authorized carrier's exclusive possession, control and use of the equipment during the lease, and its complete responsibility for the operation. The same subsection expressly says this provision is not intended to affect whether the lessor or driver is an employee or an independent contractor. The regulatory language therefore must be read as a whole.[2]
Avoiding a shortcut to civil liability
The leasing rule identifies contractual responsibilities within a regulated arrangement. It does not eliminate the need to identify the relevant state-law theory in a civil case. A contractor description should not end the inquiry, but neither should the federal control clause be described as automatic liability for every person connected with the truck. The carrier, equipment owner and driver may have different roles that require separate evidence.[2][3]
